Our terms for
collaboration.
These terms describe the agreements between Curabrand and our clients.
Curabrand
1. General
These terms apply to all offers and agreements with Curabrand. Deviations are only valid if agreed upon in writing. The applicability of client terms is expressly rejected.
2. Quotations
All quotations are valid for 30 days and without obligation. An agreement is established after written confirmation or at the start of activities. Obvious errors in quotations are not binding.
3. Execution
We execute assignments carefully according to the agreed terms. The client ensures timely delivery of required materials. Given deadlines are indicative. Changes to the assignment may adjust delivery time and costs.
4. Pricing
Prices exclude VAT. For projects, we use this payment structure:
40% at the start
40% at initial delivery
20% at final delivery
5. Payments
Payment within 14 days after invoice date. Late payment incurs statutory interest and collection costs. Objections to invoices must be reported within 8 days.
6. Intellectual Property
After full payment, the client receives usage rights for the delivered work. Source files remain our property. The client guarantees that provided materials do not infringe on third-party rights.
7. Liability
Our liability is limited to the invoice amount and maximum coverage by our insurance. We are not liable for indirect damages or damages caused by materials provided by the client.
8. Privacy
We process personal data according to GDPR legislation and our privacy policy. Both parties treat business information confidentially.
9. Delivery
After delivery, the client has 14 days for inspection and acceptance. Minor adjustments will be made free of charge. Larger changes are considered additional work.
10. Maintenance
Technical support and updates for 3 months after delivery. After that, available via maintenance contract. Emergency work at adjusted rates.
11. Cancellation
Upon cancellation, costs incurred and hours worked will be charged. For cancellation within 48 hours before work begins: 25% of the project sum.
12. Force Majeure
In case of force majeure, we may suspend obligations. Force majeure includes: illness, technical failures, government intervention, and other unforeseen circumstances.
13. Complaints
Complaints about delivered services must be reported in writing within 8 days of discovery. Complaints do not suspend payment obligations.
14. Dissolution
In case of bankruptcy, suspension of payment, or non-fulfillment of obligations, we may immediately terminate the agreement.
15. Changes
We may change these terms. The most current version is available on our website. Changes also apply to existing agreements.
16. Applicable Law
Dutch law applies. Disputes will be submitted to the competent court in our district.
